Federal Appeals Court Upholds Biden's Vaccine Mandate

A three-judge panel from the Sixth Circuit Court voted 2-1 to reinstate the Biden administration's vaccination policy for private businesses with more than 100 employees. This vote dissolves the stay on the mandate put in place by the Fifth Circuit Court.

The deadline to conform to the mandate is January 4, 2022, but the Department of Labor said in a statement they "will not issue citations for non-compliance with any requirements of the Emergency Temporary Standard (ETS) before January 10, and will not issue any citations for noncompliance with the standard's testing requirements before February 9," so long as the employer is "exercising reasonable, good faith efforts" to comply with the standard.
